The Gambling Bill is now the Gambling Act 2005.
The HLA are pleased that following the Transition period estimated to
complete in late 2007:
- there will no longer be the arbitrary 35% expenses and 55% prizes
limits of proceeds
- there will no longer be limits on the price of a lottery ticket
- we may then use the internet and mobile phones for new lotteries -
subject to licencing
- ‘rollovers’ are now permitted
Also - that the House of Lords further recommended:
- a review of the current level of annual financial limits within this
calendar year (not an immediate increase as requested but the chance
for an increase is still there!).
- to instruct the Gambling Commission to advise the Government every
3 years on the suitability of the annual limits which are current at
the time ( not a formal review as we wanted but a start!).
- to encourage the Gambling Commission to vigorously police illegal
lotteries masquerading as prize competitions ( at least a start to look
at these seriously!).
However - the HLA continue to remain concerned that:
- the 3 year regular review is not formalised and could just be forgotten
/ side stepped.
- the additional licence fees will increase and add to our costs - the
hospices will effectively pay these additional costs.
- the reserve power to impose a 'problem gambling' levy will be used
and further increase our costs again - nobody knows by how much.
The HLA will endeavour to work with the government, Gambling
Commission and Lotteries Council to influence the level of annual
limits, the setting of the licence fees and the avoidance of the levy
and take a lead in all matters relating to Hospice Lotteries.
